Legal matters to be considered while constructing a house



 1. First of all, when you buy a land, find out if it has clear deeds. The Land Registration Office can find out more about this. Because of this we have seen many conflicts even between brothers and sisters in the same family.

 

2. Be sure to find out the access road to the house. Obtain a street line drawing from the Divisional Secretariat for this purpose.

 

3. Get the plan of the building to be constructed approved by the Municipal Council or the Pradeshiya Sabha to which the plot belongs. No unauthorized construction or alteration can be done within the limits of the Municipal Council and the Pradeshiya Sabha. There are many benefits to be gained.

 

(-) When obtaining a home loan from a financial institution that does not have sufficient funds to construct the building, it is mandatory to present clear deeds and approved plan.

 

(-) In case of subsequent demolition of your building during a major construction (expressway), an approved plan should be submitted to obtain compensation.

(-) If your home is damaged in an emergency, you must submit an approved plan for compensation.

 

(-) An approved copy of the previous plan should also be submitted when the building is later vacated and approved. (A building constructed without approval will have to pay a fine according to the number of years in the process of being approved later.)

 

4. It is not permitted to change the boundary or fence of a land without proper permission. Boundary stones used in allotment of land cannot be removed or changed.

 

5. The distance from the center point of the entrance to the house within the boundaries of the Pradeshiya Sabha to the building should be at least 20 feet (This length may vary depending on the Pradeshiya Sabha.

 

6. The boundary of the building should be at least 7 feet from the boundary of the building to the boundary of the other side of the Pradeshiya Sabha. Only a bare wall without windows or doors should be 5 feet. Make sure rainwater does not fall on other lands. Do not leave any windows or doors open. You can only use something like glass bricks to get the light.

 

7. In the case of a Pradeshiya Sabha, the distance between the toilet and the well should be at least 40 feet. This is also reduced to about 30 feet within the city limits.

 

8. Each room in the house should be 1/8 the size of the walls (doors, windows). Otherwise, create a central courtyard and place windows for ventilation.
